1. Acceptance

By using this website or signing up for the Żubrówka Product Line SMS program operated by The Brand Collective LLC ("The Brand Collective", "we", "us", or "our"), you agree to these Terms of Service. If you do not agree, do not use the website or sign up for the SMS program.

2. Eligibility

You must be at least twenty-one years of age and a legal resident of the United States to use this website or sign up for the SMS program. By using the website or submitting the opt-in form, you confirm that you meet both of these requirements.

3. SMS messaging program terms

3.1 Program description.

The Żubrówka Product Line SMS program sends transactional messages, marketing messages, or both, from The Brand Collective LLC to subscribers who have explicitly opted in through our website.

3.2 Opt-in.

You opt in by checking the relevant consent box on our opt-in page and providing a valid U.S. mobile phone number. Each consent box is separate. Opting in is voluntary and is not a condition of any purchase.

3.3 Message frequency.

Up to four messages per month per opted-in category.

3.4 Fees.

The Brand Collective LLC does not charge a separate fee for messages sent through this program. Message and data rates may apply, based on your wireless plan.

3.5 Help.

Text HELP to the program number for assistance. You will receive a reply with the program name, the brand name, and a customer support contact. You can also email [email protected].

3.6 Opt-out.

Text STOP to the program number at any time to opt out. You will receive a single confirmation message. After that, you will receive no further messages from the program unless you opt back in.

3.7 Supported carriers.

Supported carriers include AT&T, T-Mobile, Verizon, U.S. Cellular, and other major U.S. wireless carriers. Carriers are not liable for delayed or undelivered messages.

3.8 Mobile number changes.

If you change, deactivate, or transfer the mobile number you used to opt in, you agree to notify us promptly by texting STOP or by emailing [email protected] so that we do not send messages to the next owner of the number.

4. License to use the website

The Brand Collective LLC grants you a personal, non-exclusive, non-transferable, revocable license to access and use this website for lawful purposes. You may not use the website to violate any law or to interfere with its operation or security.

5. Acceptable use

You agree not to:

a. Submit false, misleading, or third-party information on any form.

b. Use the SMS program to harass or harm any person.

c. Attempt to access non-public areas of the website or interfere with its security.

d. Scrape, frame, mirror, or republish website content without prior written permission.

6. Intellectual property

All trademarks, logos, product names, and brand assets, including "Żubrówka" and "The Brand Collective", are the property of their respective owners. You may not use, copy, or display them without prior written permission, except as expressly permitted on the website.

7. Third-party links

The website may contain links to third-party websites. We are not responsible for the content, privacy practices, or terms of any third-party site.

8. Disclaimers

The website and the SMS program are provided on an "as is" and "as available" basis, without warranty of any kind, express or implied. To the maximum extent permitted by law, The Brand Collective LLC disclaims all warranties, including the warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the maximum extent permitted by law, The Brand Collective LLC, its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the website or the SMS program. Our total aggregate liability for any claim shall not exceed one hundred U.S. dollars.

10. Indemnification

You agree to indemnify, defend, and hold harmless The Brand Collective LLC, its officers, directors, employees, and affiliates from any claim, loss, or demand, including reasonable attorneys' fees, arising out of your breach of these Terms or your misuse of the website or the SMS program.

11. Termination

We may suspend or terminate your access to the website or the SMS program at any time, with or without notice, for any reason, including breach of these Terms.

12. Governing law and venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Florida.

13. Changes to these Terms

We may update these Terms at any time. The effective date at the top of these Terms reflects the most recent update. Continued use of the website or the SMS program after changes are posted constitutes acceptance of the updated Terms.
